In case of any discrepancies between these Terms and the Rental Agreement, the Rental Agreement will prevail.
Eligibility Criteria
Renting a vehicle requires:
- To rent a vehicle from Car Hire in Hamilton, you must be at least 21 years old, though age restrictions may differ depending on the vehicle type. A valid and full driving licence suitable for the vehicle category is required, along with identification and proof of your current address. You will also need to present valid payment information and security deposit, and meet any further criteria outlined in the Rental Agreement.
Booking and Payment Process
- Reservations can be completed via our website, over the phone, or directly at our Hamilton office. A deposit may be necessary to confirm your booking. Full payment along with a security deposit is usually payable upon vehicle pickup. All charges are listed in British Pounds (£) and include VAT where applicable. We accept major credit and debit cards, with transactions handled securely by established payment processors.
Vehicle Pickup and Drop-off
- At the time of vehicle collection, it is your responsibility to conduct a thorough inspection and report any pre-existing damage without delay. A vehicle condition report will be prepared and signed by both parties. When returning the vehicle, it should be in the same condition as when it was collected, aside from normal wear and tear. You are liable for any damage or loss up to the excess amount specified, except where additional insurance applies. Any damage resulting from negligence or misuse remains your responsibility, irrespective of insurance coverage.
6. Modifications and Cancellations
Cancellation and amendment policies depend on the type of booking and the notice period provided. For precise information, consult your booking confirmation or Rental Agreement. Be aware that late cancellations or no-shows may incur additional charges.
7. Restricted Activities
Prohibited Uses of the Vehicle
- The vehicle must not be used for illegal activities, including racing, rallying, or off-roading. Transporting hazardous materials is prohibited. Sub-letting the vehicle or allowing unauthorized drivers is not permitted. Driving under the influence of alcohol or drugs is strictly forbidden. The vehicle should only be used for its intended purpose and within specified passenger and weight limits. Driving outside designated geographical areas requires prior approval.
Breach of these terms may lead to rental termination and extra fees.
Liability Limitations
To the fullest extent allowed by English and Welsh law, Car Hire Hamilton will not be responsible for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business, related to your use of our services. Our total liability for any claim is capped at the amount you paid for your rental in the past 12 months. This limitation does not apply to liability for death or personal injury resulting from negligence or fraud.

These Terms are governed by the laws of England and Wales. Disputes will fall under the exclusive jurisdiction of the courts in this region.
